Аграрне законодавство США 1789–1865 рр.: від земельних ордонансів до закону про гомстеди

Анотація
Метою статті є комплексний аналіз аграрного законодавства США 1789 – 1865 рр. як інструменту
формування американської моделі державності та регулювання земельних відносин у процесі територіальної експансії.
Висновки. У статті здійснено комплексний аналіз із історії аграрного законодавства Сполучених Штатів
Америки від ухвалення Конституції 1789 р. до завершення Громадянської війни та підписання Закону про гомстеди 1862 р. На підставі першоджерел і новітніх досліджень з аграрної історії США розглянуто ключові нормативноправові акти: Земельний ордонанс 1785 р., Ордонанс про Північно-Західну територію 1787 р., серію преемптивних законів 1830 – 1841 рр., Закон Моррілла 1862 р. та Закон про гомстеди 1862 р.
Досліджено засади федеральної аграрної політики, еволюцію механізмів відчуження публічних земель, правовий
режим плантаційного землеволодіння на Півдні та фермерського – на Заході. З’ясовано, що аграрне законодавство цього періоду відображало глибокі суперечності між вільнонайманою працею й рабством, між федеральним центром і штатами, між спекулятивним капіталом і дрібним фермерством. Зроблено висновок, що ухвалення Закону про гомстеди стало кульмінацією республіканської аграрної доктрини й кардинально змінило правові засади землекористування в США.
